Punica App User Agreement

1. Definitions and General Provisions

This Agreement regulates the relationship between Punica App ("Punica" or the "Company") and all corporate clients and authorized users ("User") accessing or utilizing its services.

By using Punica's services, acceptance of all terms and conditions herein is presumed.

Punica is committed to providing a secure, transparent, and lawful digital environment, operating fully in line with applicable data protection, consumer rights, and digital services laws. The purpose of this Agreement is to define the rights, responsibilities, and expectations governing the use of the platform.

2. Description of Services and Conditions of Use

Punica offers a comprehensive software platform aimed at streamlining business operations through digital transformation. The platform includes:

  • Punica People for managing employee information and HR processes
  • Punica Tasks for task tracking and project coordination
  • Punica Partners for maintaining customer and supplier relations
  • Punica Inventory for inventory and stock management

Use of the platform must be limited to the scope of authorization granted by the employing organization or institution. Any misuse, such as unauthorized access, alteration of platform functionalities, submission of misleading data, or participation in illegal activities, is strictly forbidden.

Punica reserves the right to monitor platform usage and implement protective measures against any conduct that could jeopardize system integrity or violate the terms of this Agreement.

3. User Responsibilities

All actions performed on the platform must align with the intended use and legal obligations.

Users are obligated to maintain the confidentiality of their credentials (username, password, security settings). If unauthorized access or suspicious activity is detected, it must be reported to Punica immediately. Failure to do so may result in liability for any damages caused.

Only accurate, up-to-date, and complete information should be provided. Submitting false or misleading information could compromise system operations and may lead to account suspension or termination.

Content provided by Punica, including software, data structures, and documents, is protected by intellectual property laws. No copying, reproduction, or distribution of these materials is permitted without explicit consent.

Any attempt to harm, disable, or disrupt the system, including hacking, introducing malware, or reverse engineering, is strictly prohibited.

All actions taken must comply with applicable national and international laws, particularly those relating to data protection and information security.

Users remain fully responsible for all content they upload to the system and must ensure it is lawfully obtained, appropriate, and does not infringe on third-party rights.

Punica may suspend or terminate accounts in the event of breach and may seek compensation for any resulting damages.

4. Data Security

Personal data processed within Punica shall be protected with the highest industry standards.

Personal information will be collected and used strictly for delivering services, improving user experience, and fulfilling legal obligations. Users will be clearly informed about what data is collected and why.

Requests to access, correct, transfer, or delete personal data will be honored in accordance with applicable laws.

Data will be encrypted both in transit and at rest. Access controls and multi-factor authentication will be employed to ensure that only authorized personnel can access sensitive information.

In the event of a data breach, affected users and the relevant regulatory authorities will be promptly notified in compliance with legal requirements.

5. Cookies and Tracking Technologies

Cookies and tracking technologies shall be used to personalize and improve the user experience, subject to prior consent.

Categories of Cookies:

  • Essential Cookies: Necessary for platform functionality
  • Functional Cookies: Used to remember user settings and preferences
  • Analytical Cookies: Used for performance monitoring and service improvement
  • Advertising Cookies: Used by third parties to deliver relevant advertisements

Users have full control over their cookie preferences and can withdraw consent at any time without affecting essential platform functionality.

Marketing communications will only be sent with explicit consent, and opt-out options will always be provided.

6. Third-Party Services and Data Sharing

Personal data may be shared with third parties only under strict conditions, either in fulfillment of legal obligations or upon explicit consent of the data subject.

Certain third-party vendors may be engaged to provide technical infrastructure, data analytics, or customer support services. In such cases, only the minimum necessary data will be shared, and confidentiality obligations will be contractually enforced.

If required by law or regulatory order, personal data may be disclosed to public authorities, courts, or regulatory agencies. Such disclosures shall always be limited to what is strictly necessary to comply with legal obligations.

Where explicit user consent has been obtained, personal data may be shared with trusted business partners involved in service provision or integration.

Where personal data is transferred outside the European Economic Area, appropriate safeguards, such as Standard Contractual Clauses (SCCs) under GDPR, will be applied to ensure data protection standards are maintained.

Data sharing processes are fully transparent, and Users retain the right to request information about the scope and recipients of shared data.

7. Access and Authorization

Access to Punica's services is granted only following the successful completion of the registration process and explicit acceptance of this Agreement.

Access rights and permissions must be configured and controlled by the organization or individual responsible for the User account. Punica does not intervene in internal authorization processes unless contractually obligated.

Services must be accessed and utilized strictly within the authorized parameters assigned. Unauthorized attempts to expand or bypass these permissions constitute a breach of this Agreement and may result in access suspension or legal action.

To maintain platform integrity and information security, access may be audited periodically, and adjustments to permissions may be made as necessary.

8. Fees and Payment Terms

All fees related to the use of Punica's services must be paid in accordance with the published terms and conditions.

Fees may vary depending on the selected service package, the scope of services, and the agreed usage period. Current fee schedules and payment terms are published on Punica's official communication channels.

Requests to change or upgrade service packages shall take effect at the end of the current billing period unless otherwise expressly agreed. Mid-term cancellations or changes shall not entitle Users to partial or full refunds unless otherwise mandated by law.

Users are responsible for providing accurate billing and contact information. All applicable taxes, duties, and legal charges shall be borne by the User.

In the event of non-payment or delay in payment, Punica reserves the right to suspend or restrict access to services without prior notice. Services may be reinstated following the fulfillment of outstanding payment obligations and any additional administrative conditions imposed.

9. User Rights and Complaint Mechanisms

Punica is committed to protecting individual rights regarding personal data and service usage.

Users have the right to request access to their personal data processed by Punica and obtain information regarding the purposes and scope of such processing.

Where personal data is inaccurate or incomplete, Users have the right to request correction. Under appropriate conditions, Users may also request the deletion or anonymization of their data.

Users may object to the processing of personal data based on legitimate interests or other legal grounds. In such cases, the processing shall cease unless overriding legal grounds are demonstrated.

Upon request, personal data shall be provided in a structured, commonly used, and machine-readable format and may be transferred directly to another data controller where technically feasible.

Consent to data processing activities may be withdrawn at any time, without affecting the lawfulness of prior processing.

Users have the right to lodge complaints directly with Punica's support team or escalate the matter to the relevant supervisory authority in the event of perceived data protection violations.

Punica has established clear internal procedures to facilitate the prompt handling of user rights requests and complaints.

10. Amendments and Updates

Punica reserves the right to amend and update this Agreement to reflect changes in legal requirements, industry standards, or service enhancements.

Any material changes to this Agreement will be communicated in advance through official channels, such as email notifications or platform announcements.

Amendments shall become effective on the specified effective date. Continued use of the platform after the effective date shall constitute acceptance of the revised terms.

Users and corporate clients are encouraged to provide feedback regarding amendments, which will be taken into account to continuously improve the services and contractual framework.

It is recommended that Users periodically review the Agreement to stay informed about the current terms and conditions.

11. Dispute Resolution

All disputes arising from or in connection with this Agreement shall be governed by applicable laws and regulations.

In the event of a dispute, the parties shall first endeavor to resolve the matter amicably through direct and good-faith negotiations.

If a resolution cannot be achieved through negotiation, Users retain the right to seek remedies through alternative dispute resolution mechanisms or by applying to the competent judicial authorities.

Disputes shall be referred to the competent courts determined under the applicable laws, unless otherwise agreed in writing between the parties.

In cases related to the processing of personal data, Users may submit complaints either directly to Punica or to the competent data protection authority.
